Terms of Service

1) Agreement to these terms

By creating an account, signing in with Google, purchasing a plan, or using GigRank, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. “GigRank,” “we,” and “us” refer to the GigRank product and operators. “You” refers to the account owner and any person using your account.

2) What GigRank does (and does not do)

GigRank provides AI-assisted profile and proposal optimization tools for freelance marketplaces. We analyze text you submit and return suggestions intended to improve profile clarity and visibility. GigRank is a software tool and not an employer, recruiter, agency, or job-placement service.

3) Marketplace independence

GigRank is independent and is not affiliated with, endorsed by, or sponsored by Upwork, Fiverr, Freelancer.com, or their parent companies. Their ranking systems, policies, moderation behavior, and product interfaces can change at any time and without notice.

4) No outcomes guarantee (important)

We do not guarantee you will get jobs, clients, invitations, interviews, revenue, rankings, account growth, or any specific business result. Client hiring decisions are made by clients, not by GigRank. Marketplace distribution and discovery are controlled by marketplace systems that we do not control.

Any examples, scores, recommendations, benchmarks, or historical improvements shown in the app are informational only and are not a promise of future performance.

5) AI output and your responsibility

AI output can be incomplete, outdated, or incorrect. You are solely responsible for reviewing, editing, and validating all content before publishing it anywhere. You must ensure your profile, proposals, and messages are truthful and compliant with all applicable marketplace rules and laws.

6) Account security and eligibility

You are responsible for account activity under your credentials. Keep your login information secure and notify us immediately of unauthorized use. We may suspend or terminate accounts for security reasons, abuse, fraud risk, or policy violations.

7) Acceptable use

  • Do not use GigRank for unlawful, deceptive, infringing, or fraudulent activity.
  • Do not attempt to bypass plan gates, limits, or security controls.
  • Do not reverse engineer, extract, scrape at scale, or resell the service or output as a competing product.
  • Do not use GigRank in ways that violate marketplace policies (Upwork, Fiverr, Freelancer.com, etc.).

8) Plans, billing, and refunds

Paid plans are billed through our payment processor. Unless required by law, subscriptions are non-refundable after a billing period starts, including partial-use periods and dissatisfaction with outcomes. We may change prices and plan structures prospectively.

9) Data and content rights

You retain rights to your submitted profile/proposal content. You grant us a limited license to process and store that data to operate the service. You represent you have legal rights to all content you submit.

10) Warranty disclaimer

GigRank is provided “as is” and “as available,” without warranties of any kind (express or implied), including fitness for a particular purpose, accuracy, non-infringement, availability, or uninterrupted operation.

11) Limitation of liability

To the maximum extent permitted by law, GigRank and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of clients, account restrictions, or reputational harm. Our aggregate liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

12) Indemnity

You agree to defend, indemnify, and hold harmless GigRank and its operators from claims, liabilities, damages, and costs arising from your misuse of the service, your submitted content, or your violation of these Terms or applicable laws.

13) Suspension and termination

We may suspend, limit, or terminate access at our discretion for abuse, legal risk, security reasons, chargebacks, or violation of these Terms. We may also remove content that creates legal or platform-policy risk.

14) Terms acceptance records

For legal and security purposes, we may store records of your terms acceptance, including timestamp, accepted version, IP address, and user agent. These records are used as evidence of acceptance where permitted by law.

15) Changes to these terms

We may update these Terms at any time. Updated terms are effective when posted unless stated otherwise. Continued use after an update means you accept the revised Terms.

16) Governing law

These Terms are governed by applicable law in the jurisdiction where GigRank operates, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.
